Welcome to linkbloom (the "Platform"), operated by us ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Platform, including any content, functionality, and services offered on or through the Platform (collectively, the "Services").

The Services are available to users worldwide. By accessing or using the Services, you agree to be bound by these Terms, regardless of your location. If you do not agree, you may not use the Services. These Terms apply to all users, including visitors, registered users ("Users"), content creators ("Creators"), and buyers ("Buyers"). You are responsible for complying with all applicable local, national, and international laws, including export controls and sanctions (e.g., US OFAC lists, EU Regulation 2021/821). We reserve the right to restrict access from certain jurisdictions.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent that you meet this requirement, have the legal capacity to enter into contracts, and are not barred from using the Services under applicable laws (e.g., not on any sanctions lists).

2. Accounts and Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms, including fraudulent activity, excessive chargebacks, or non-compliance with international laws.

3. User Content and Links

The Platform allows Users to create profiles with links to external content ("Links") and Creators to upload and sell digital products ("Digital Products"), such as PDF courses, ebooks, or other downloadable files.

  • Your Responsibilities: You are solely responsible for the content you post, including Links and Digital Products ("User Content"). User Content must not: infringe intellectual property rights; be illegal, harmful, or deceptive; promote violence, discrimination, or hate; contain malware; or violate applicable laws in any jurisdiction.
  • License Grant: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as necessary to provide the Services.
  • Prohibited Content: We prohibit User Content involving child exploitation, terrorism, illegal weapons, controlled substances, or any disallowed activities per our policies. We may remove violating content without notice.
  • DMCA/Intellectual Property: If you believe User Content infringes your rights, contact us at support@linkbloom.io with details. We comply with applicable notice-and-takedown procedures, including the US DMCA for relevant users.
  • Global Compliance: User Content must not violate international laws (e.g., export controls on sensitive technology).

5. Selling and Buying Digital Products

For Creators

You may sell Digital Products through the Platform. You set prices, descriptions, and policies, but must comply with global consumer laws (e.g., US FTC guidelines for accurate advertising). Digital Products must be accurately described, conform to promises, and be free from defects. You handle customer support for your products.

Delivery

Upon purchase, Buyers receive immediate access to download or view Digital Products via email link or Platform dashboard. Delivery is deemed complete upon sending the access link.

For Buyers

Purchases are final for Digital Products due to their nature (instant delivery and non-returnable). Review product descriptions carefully before buying.

Payments

We use third-party processors (e.g., Stripe) for transactions. You agree to their terms. We charge a 10% platform fee on sales. Payouts to Creators occur on a rolling basis, minus fees, refunds, or chargebacks.

Taxes and Sales Tax

Prices include applicable taxes (e.g., US state sales tax, VAT equivalents for international). We collect and remit taxes as required globally (e.g., US Marketplace Facilitator laws for cross-state sales, EU VAT MOSS if applicable). Creators are responsible for their tax obligations; we may withhold or report as required by law (e.g., IRS Form 1099 for US payers).

6. Refunds, Chargebacks, and Disputes

Refund Policy

Creators may set their own refund policies (e.g., no refunds, 7-day guarantee), displayed at checkout. However, we reserve the right to issue refunds within 90 days to resolve disputes or prevent chargebacks, per our discretion. Refunds do not apply to Digital Products once accessed/downloaded, except where required by law.

No Refunds for Subjective Value

Dissatisfaction with a Digital Product's content, value, or usefulness (e.g., "I didn't find the course valuable") is not grounds for a refund or chargeback. Buyers acknowledge this at checkout.

Chargebacks

If a Buyer initiates a chargeback, the Creator is responsible for reimbursing us for the disputed amount, any processor fees, and related costs. Excessive chargebacks may lead to account suspension. We handle disputes in our sole discretion but encourage Creators to provide evidence of delivery (e.g., access logs).

Global Consumer Rights

US users have rights under FTC rules and state laws (e.g., California remedies for defective products). Non-US users agree to stricter policies, except where local laws mandate otherwise (e.g., EU 14-day withdrawal, waived with consent).

7. Protections for Users, Buyers, and Sellers

  • For Buyers: We require Creators to provide accurate descriptions and support. If a Digital Product is defective or non-conforming, contact the Creator first; we may mediate. Your personal data is protected—see our Privacy Policy.
  • For Creators/Sellers: Buyers agree not to share, resell, or redistribute purchased Digital Products without permission. We protect your IP by monitoring for violations and providing tools to track downloads. You indemnify us against claims arising from your User Content.
  • For All Users: Prohibit harassment, spam, or misuse. We limit our liability for user interactions. Report violations to support@linkbloom.io.
  • Platform Protections: You agree to indemnify us against losses from your use of the Services, including chargebacks, disputes, or violations. We are not liable for User Content or third-party links.
  • Global Protections: We comply with international standards (e.g., anti-money laundering via KYC if required in certain jurisdictions).

8. Limitations of Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or punitive damages arising from the Services, including lost profits or data. Our total liability is limited to the fees paid by you in the past 12 months. We provide the Services "as is" without warranties.

This does not affect statutory rights under applicable laws (e.g., EU/US consumer protections).

9. Termination

We may terminate or suspend your access for violations, non-payment, or at our discretion. Upon termination, unpaid earnings may be forfeited if due to violations.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia and the European Union. For EU users, disputes may be resolved in your local courts per consumer protection regulations. For US users, you may opt into arbitration under AAA rules or file complaints with the FTC. For other regions, contact us for alternative resolution options.

11. Miscellaneous

  • Changes: We may update these Terms; continued use constitutes acceptance. We will notify users of material changes.
  • Severability: Invalid provisions do not affect the rest.
  • Force Majeure: We are not liable for delays due to events beyond our control.
